These are the Terms and Conditions which apply during use of Code Plus Inspections websites, apps, and any other services we provide. By using these services, you agree to the following terms and policies.

“User” means any person, company, or entity who has an account with Code Plus Inspections or makes use of any service, function, or feature provided by Code Plus Inspections.

“Provider” means Code Plus, Inc., owner of the Code Plus Inspections website and software.

“Services” means the Code Plus Inspections website and software, and any program, function, or feature that is provided or facilitated by either the Code Plus Inspections website or software programs.

Terms and Conditions:

All rights not specified herein are reserved by the Provider. Use of Services owned by the Provider is contingent on abiding by this agreement and other policies, and by the User’s use of the Provider’s Services you agree to be bound by these terms. Access to data, services, software, and all other material hosted on, provided by, or used on this website may be revoked at any time for any reason by the Provider without advance notice or warning. Any unauthorized use of these Services is prohibited and may result in criminal or civil penalties. All material is proprietary and subject to the terms of this license agreement. The Provider retains all ownership of the software and reserves all rights not explicitly granted to the User. Copying or redistribution of source code without authorization from the Provider is strictly prohibited. This software is provided by the Provider “as-is” and the Provider disclaims any and all express or implied warranties as to the adequacy, sufficiency, or functionality of these Services. If applicable legislation or judicial rulings impose financial penalties, the Provider cannot be held liable for a larger payment than the cost paid by the injured party for services rendered for the specific instance.

The Provider retains the rights to all information, data, photos, reports, and documentation uploaded to the website or software. By uploading pictures, photos, or other documents to the website or software, the User grants the Provider full, royalty-free, transferable, worldwide, and unlimited rights to copy, use, delete, modify, or display this content. Notwithstanding, the Provider shall have no liability and cannot be held accountable for the presence of such content or material if it is present on the website or software. The Provider is not responsible for the accuracy, validity, timeliness, legitimacy, completeness, decency, or legality of any data or information present on the website or software.

These Services are only a service to facilitate the inspection process, and all responsibility for meeting the inspection requirements of any jurisdiction lies with the User submitting the inspection; the Provider bears no responsibility and makes no claim or guarantee that any inspection or permit will be accepted or granted by any jurisdiction. The Provider is only a facilitator for inspections and makes no warranty as to the accuracy, veracity, or adequacy of any information provided by others in their use of this website or software. The Provider does not guarantee or make any claim as to the actual site conditions represented by the Users of this website or software. The Provider is not responsible for performing any specific code compliance enforcement or determination, and has no culpability for information or data that is submitted or provided through this website or software. The Provider is not obligated or responsible to update inspection requirements to comply with current codes. The Provider only operates these Services to facilitate inspections under the sole direction of the public entities who utilize this inspection website or software, and is therefore held to the same rules and regulations applicable to the liability of such public entities.

The Provider is not liable or responsible for length of time that may occur between the submission of an inspection request, the processing of that request by the jurisdiction, or the receipt of a response from the jurisdiction, and is not liable or responsible any loss of time, money, progress, opportunity, contracts, or sales that may occur as a result of these times. The Provider is not responsible or liable for and has no control over the hours of operation or availability of any jurisdiction or governing authority. The use of this service does not guarantee the complete or partial approval of any inspection or project. The Provider does not collect any permit or inspection fees on behalf of any jurisdiction whatsoever.

Oral or textual information, recommendations, or advice given by an authorized representative of the Provider shall not create any warranty or guarantee apart from those contained in these terms and conditions.

Location data may be collected by the Provider from data uploaded by the User in order to improve the User website experience on the website and software usability. Personal data from the User may be collected and utilized by the Provider.

It is the responsibility of the User to follow all applicable local, state, and federal laws and regulations while using the website or software, or while taking any actions that may be required to complete an inspection or fulfill the requirements of a jurisdiction. This includes but is not limited to Operational Safety and Health Administration (OSHA) rules, as well as any other state or local safety and health requirements. The Provider shall have no responsibility to check, verify, or report that the Users of this website or software abided by any applicable rules, laws, statues, or ordinances. The Provider has no responsibility to check that Users of this website or software possess any licenses, certifications, worker’s compensation policies, or liability insurance, or meet any federal, state, or local requirements to legally perform work in any area, location, or sector. It is the property owner’s responsibility to provide full and safe access to the entire jobsite or area being inspected. The Provider is not responsible in any way, shape, or form for any injuries or accidents, whether mental or physical, that may occur during inspection or construction process.

The Provider reserves the right to cease or refuse to provide access to these Services to any person, company, jurisdiction, or other entity for any reason. The Provider makes these Services available to contractors and jurisdictions approved by the Provider. No User shall access or make use of the Provider’s Services if the User is: under the age of 18 (or under the recognized age of adulthood in the User’s country of residence), a convicted sex offender, a person prohibited from accessing the Provider’s Services due to applicable laws, or if the User’s account has been previously terminated due to violations of these Terms and Conditions.

If any part or portion of these terms and conditions be found unenforceable by an appropriate jurisdiction or legitimate court of law, the remainder of these terms and conditions shall remain in full effect.
